Single User Version: You have the right to run the single user version on one (1) Central Processing Unit (CPU) supporting a single database used for a single fire department. Network Version: You have the right to run the network version on one (1) server supporting a single database for a single fire department. Each CPU which is not physically connected to the server and sharing a single database requires a separate license. |

| FirePrograms grants you a nonexclusive, non-transferable license to use the enclosed computer program (“The SOFTWARE”) on a single computer system, subject to the terms and conditions of this License and Warranty Agreement. |
| Copyright and Permitted Use |
| The software is owned by FirePrograms or its suppliers and is protected by United States copyright law and international treaty provisions. Treat the SOFTWARE exactly as if it were a book, with one exception: You may make archival copies of the SOFTWARE to protect it from loss. The SOFTWARE may be moved from one computer to another, as long as there is no possibility of two persons using it at the same time. |
| Warranty and Liability |

FirePrograms warrants the physical disk and documentation enclosed to be free of defects in materials and workmanship. The user is totally and absolutely responsible for determining that the software operates in the manner expected, and that the user’s personnel are fully trained in the operation of that software. In determining the fitness for a particular purpose the user should rely solely on actual review of the operation of the software and not on any other representation, including the documentation. The user must be aware that changes may be made to the software that are not covered in the documentation or in the help screens. In addition, when updates to the software are installed, the user is responsible for reviewing the update for changes, which may affect operation of the softwareto ensure that operation of the software, and the users operation of the software meets the users requirements. It is the Users responsibility to maintain a routine backup system, adequate to the Users needs. In the unlikely event that a data file becomes physically or logically changed, FirePrograms is not responsible for the reconstruction of the data files. Changes made to the software by the user to customize it to his specific needs, including data analysis reports created by the user, may not be supported by updates. The above warranty is in lieu of all other warranties, whether written or verbally implied. FirePrograms SPECIFICALLY EXCLUDES ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FirePrograms shall not be liable with respect to the SOFTWARE or otherwise for special, incidental, consequential, punitive, or exemplary damages even if advised of the possibility of such damages. In no event shall liability for any reason and upon any cause of action whatsoever exceed the purchase price of the SOFTWARE. |
| General |
| You may not sub-license, assign, or transfer the enclosed computer programs to another party unless that party agrees to accept the terms and conditions of this Agreement. If you transfer the programs you must at the same time either transfer all copies to the same party or destroy any copies not transferred. This Agreement shall be governed by the laws of the State of Florida. |
